Provisional Replacement with Non-Provisional

- Must be completed within one year of
provisional application filing date
- No financial/other hardship exceptions
- No extensions
- Must claim priority from provisional
application
- Quite a new stage - provisional underwent no
USPTO examination and non-provisional will undergo rigorous examination on
content, format and (of greatest importance) whether claims delineate subject
matter both new and nonobvious given what is known

- Leave time for a professional patent search
- Leave time for a professional overhaul of the
provisional
- USPTO is located in Alexandria, Virginia, but

- USPTO conducts business in writing
- No reason to go there - no advantage in
personal appearances
Basic provisional replacement with minor search:
- $1,000 if provisional itself is substantially
complete and professional
- Electronic, software and business method
subjects not eligible for basic rate
- Provisional application "as filed" must be
provided electronically in Microsoft Word
- USPTO filing fee, formal drawings and
post-filing services all additional
