Patent Validity Search

Validity search overview:

  • To be patentable, the subject matter must be both new and nonobvious in comparison to what is known.

  • All patent applications (unless provisional) undergo a serious examination by a USPTO patent examiner, but the patentability question does not end there or with patent issuance.

  • The validity of an issued patent can be challenged through a reexamination request or court challenge.

  • A validity search is normally far more extensive than a patent search conducted before a patent application is filed.

  • Why is it more extensive?  Because there is normally far more at risk, requiring the extensive efforts and justifying the extraordinary costs.

  • Is a validity search worth the costs?  That is always a business decision.
