Patent application fees depend on the complexity of subject matter, the prior art against which it will be measured and other factors. Based on surveys conducted by the American Intellectual Property Law Association and other published surveys, $6,000 to $8,000 is a middle-range cost for a patent application, exclusive of costs (drawings, USPTO fees) and post-filing. The middle-range is between entry-level and definitive applications. While there is no ceiling at the extreme upper end, the firm's experience has been that some corporate-quality patent applications are realized for less than the middle-range costs. A new patent application typically starts with an inquiry by telephone or email. Before receiving any sensitive information, the subject matter must be screened to exclude conflicts with matters being handled or handled in the past. Written cost estimates are provided at the earliest practical point. The estimates provided are serious and comprehensive.
